The privacy policy for N Burns & C Burns Ltd. (T/A Lindsay Burns & Company), a company registered under the Companies Acts (SC412672) and having its registered office at 6 King Street, Perth PH2 8JA (“we/us”).

We are committed to ensuring that your privacy is protected, a matter that we take seriously. This privacy policy aims to give you information on how we collect and process your personal information through use of this website, when you sign up to our newsletter, participate in our auctions and services or apply for a job with us.

This website is not intended for children and we do not knowingly collect personal information relating to children. Nor it intended to cover our staff or people working for us.

We will only use your personal information with your consent. We will use this information to administer your account and to provide the service that you have requested from us. You can be assured that your personal information will only be used in accordance with this privacy policy, and personal information that is collected and processed is in accordance with the UK General Data Protection Regulation, Data Protection Act 2018, Data Use and Access Act 2025 and any other applicable data protection law  (“Data Protection Law”).

We may change this notice from time to time. This notice was last updated in 20th March 2026 .

You have the right to make a complaint at any time to us and you may do so by contacting us at the details noted above.  We will acknowledge your complaint within 30 days and provide you with a response without undue delay.  If you are not happy with our response you can complain to the Information Commissioner’s Office (ICO), the UK supervisory authority for data protection issues (www.ico.org.uk).

What we collect

Personal data or information means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data). We may collect the following personal information to undertake one of the services that you have requested:

  • Name;
  • Contact information including address, postcode, telephone numbers and email address; VAT number if applicable
  • Bank details (to process vendor payments if requested by the vendor or to pay a supplier);
  • Details and sale estimates of goods to be valued for auction or for a written valuation, removal service or storage; 
  • Details required for bidding including lot numbers, descriptions and bidding amounts.
  • Bidding ID, previous bidding activity and history, comments about you by other auctioneers (if users input this data into the Saleroom.com). 
  • Photographic ID and a proof of address and other related information to comply with anti money laundering regulations for both vendors and buyers when required.
  • For job applicants: name, address, contact information, qualifications and educational and employment experience, other information commonly in CV or job application.

How we collect

Personal information is collected: (a) by registering and creating an account through our website; (b) by telephone; (c) by email; (d) through our vendor entry forms, registration forms and bidding forms; (e) in person (f) recruitment agencies (g) online e.g. Social Media, Companies House, Government UK Sanctions List, OFSI Consolidated List, Art Market Participants Lists  (h) information shared to us from Professionals requesting our services. (i) when expressing an interest in purchasing certain lots (j) responding to an advert and requesting our services (k) when you are introduced to us via a third party; (l) when applying for a job with us.

We also receive information from The Saleroom.com when you open an online account, enabling you to bid in our auctions. Data from this provider synchronizes with our software.

We receive information from Go Auction Ltd. Information includes your name, address, email address and telephone number, and your bidding interests and bids collected from our website when you create an account.

What we do with the personal information we gather

The law requires us to have a legal basis for collecting and using your personal information.  We rely on one or more of the following legal basis: performance of a contract with you or are about to enter into with you; consent; legitimate interest of you, us or a third party; Recognised Legitimate Interest, where we are obliged by law; or if it is in your vital interest. 

Performance of a Contract with you: We require this information to provide you with a service that you have requested from us and is used in the following ways:

  • Auction administration, office administration, accounting and book keeping and internal record keeping.
  • We may send emails notifying you of progress of lots within our auctions. We may need to disclose information to companies that we instruct to undertake and fulfil the needs of the business, such as our bank/ Card Processing system/removal/courier/storage/gemologist/accountants/IT companies/Paper Waste management/Software Provider/GOV.UK (Ivory declaration if required)
  • We may pass your details onto FCS Compliance to undertake checks for anti-money laundering requirements.
  • We will give buyer information to shippers/postage/removals companies when the buyer has independently instructed them to collect purchased lots from us.

Consent:

  • We may send emails notifying you of forthcoming auction dates, deadlines for auction entries and newsletters using the email address which you have provided. We will only send marketing emails if you have requested to receive the information.
  • We may send out complimentary catalogues for our Antique and Fine Art sales. We will only post these out if you have requested us to do so. You can withdraw consent at any time, although please note this will not affect the lawfulness of the processing prior to the point of withdrawing your consent.

Legitimate Interest: we rely on this to process your personal information if you apply for a role with us.  This is to assess whether you are suitable for the role.  We may also process your personal information on a legitimate interest basis in the event of a sale of our business or to exercise or defend our legal rights.

Recognised Legitimate Interest:  we rely on this if we need to share with the Police for prevention or detection of crime or such other Recognised Legitimate Interest set out in the Data Protection Legislation.

Vital Interest: it is not common, however if there is an emergency where we feel you are at risk, we may need to share your personal interest in order to protect your vital interest.

Legal Obligation; we may process your personal information if obliged by law.

We will only use your personal information for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If we need to use your personal information for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so. Please note that we may process your personal information without your knowledge or consent where this is required or permitted by law.

We will only retain your personal information for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting or reporting requirements. To determine the appropriate retention period for personal information, we consider the amount, nature and sensitivity of the personal information, the potential risk of harm from unauthorised use or disclosure of your personal information, the purposes for which we process your personal information and whether we can achieve those purposes through other means, and the applicable legal requirements.

We are committed to ensuring that your personal information is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure your personal information. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal information on our instructions and they are subject to a duty of confidentiality.

We have put in place procedures to deal with any suspected personal information breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

We do not transfer your personal information outside the UK.

Website

When someone visits our website we collect standard internet log information and details of visitor behaviour patterns. We do this to find out things such as the number of visitors to the various parts of our site. We collect this information in a way which does not identify anyone. We do not make any attempt to find out the identities of those visiting our website. We will not associate any data gathered from this site with any personally identifying information from any source. Information collected via our enquiry forms will only be used for the purpose of contacting you to answer your enquiry.

This website includes links to third-party websites, plug-ins and applications (in particular, www.the-saleroom.com and Go Auction Ltd) Clicking on those links or enabling those connections may allow third parties to collect or share data about you. We do not control these third-party websites and are not responsible for their privacy policies. When you leave our website, we encourage you to read the privacy notice of every website you visit.

Use of Cookies

We may also store information about you using cookies (files which are sent by us to your computer or other access device) which we can access when you visit our site in future. We do this to make our website work as you'd expect.

We use Google Analytics to monitor traffic levels, search queries and visits to this website. These cookies enable Google Analytics to determine whether you are a return visitor to the site, and to track the pages that you visit during your session. This is a simple token used to identify your unique session on this website. It is used to maintain the integrity of your session while transacting information with our website (accessing secure areas, forms submissions etc). It expires when you close your browser.

 

Controlling your personal information

You can ask us or third parties to stop sending you marketing messages at any time.. If you would no longer like to receive email notifications, you can contact us in the same way or unsubscribe from mailshots using the unsubscribe button.

Where you opt out of receiving these marketing messages, service may still need to send you service communication necessary for you to receive our service.

We will not sell, distribute or lease your personal information to third parties. We will only share your personal data with third parties if necessary to deliver our service, operate our business or for another legitimate purpose.  We will require these third parties to respect the security of your personal information and to treat in accordance with the law. You have rights under Data Protection Law in relation to your personal information, including the right to:

You will not have to pay a fee to access your personal information (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances.
